CANDIDATE TERMS & CONDITIONS

1. Introduction and Status of These Terms

These Candidate Terms & Conditions (“Terms”) govern the relationship between ALWAYS RECRUITING LIMITED (“the Company”) and any individual (“the Candidate” or “the Worker”) who seeks work through, or is supplied by, the Company.

By registering with the Company, accepting an assignment, or performing work introduced or supplied by the Company, the Worker agrees to be bound by these Terms.

These Terms do not constitute a guarantee of work and do not create an obligation on the Company to offer assignments.


2. Nature of the Relationship

ALWAYS RECRUITING LIMITED is a recruitment and labour supply business.

Unless expressly stated otherwise in writing, the Company does not guarantee continuous work, minimum hours, or ongoing engagement.

Nothing in these Terms creates a partnership, joint venture or agency relationship between the Company and the Worker.


3. Employment Status

Depending on the nature of the assignment, the Worker may be engaged under PAYE or CIS arrangements.

The Worker acknowledges that:

  • Assignments are temporary in nature

  • No obligation exists to offer or accept future assignments

  • The Company is not required to provide continuous work

The Worker’s employment or engagement status is determined by the specific terms applicable to each assignment.


4. Registration and Information Accuracy

The Worker agrees to provide accurate, complete and truthful information during registration and onboarding, including:

  • Identity details

  • Right to Work documentation

  • Qualifications, licences and experience

  • Tax and payment information

The Company relies on this information when offering assignments.

The Company reserves the right to suspend or terminate engagement where information is inaccurate, misleading or incomplete.


5. Right to Work and Vetting

The Worker must provide valid evidence of their legal right to work in the United Kingdom.

The Worker acknowledges that:

  • No assignment will commence without completed Right to Work checks

  • Engagement may be suspended or terminated if documentation expires or becomes invalid

  • The Worker must notify the Company immediately of any change to their immigration status

Failure to comply may result in immediate withdrawal of work.


6. Assignments

Assignments are offered subject to availability, suitability and client requirements.

The Company reserves the right to:

  • Withdraw or amend an assignment

  • Decline to offer further assignments

  • End an assignment where required for legal, regulatory or operational reasons

The Worker is not obliged to accept an assignment offered, but once accepted, the Worker is expected to attend and perform the assignment as agreed.


7. Conduct and Performance

While on assignment, the Worker is expected to:

  • Act professionally and responsibly

  • Follow client site rules, policies and procedures

  • Carry out duties with reasonable skill and care

  • Comply with lawful instructions

The Company may withdraw a Worker from an assignment where conduct or performance is unsatisfactory.


8. Health and Safety

The Worker acknowledges that:

  • The client controls the workplace

  • The Worker must comply with all site safety rules and instructions

  • Personal protective equipment must be used correctly

The Worker must report accidents, incidents or unsafe conditions immediately.

Failure to comply with health and safety requirements may result in removal from site and termination of engagement.


9. Timesheets and Payment

Payment is processed based on timesheets submitted and authorised in accordance with agreed procedures.

The Worker is responsible for:

  • Accurately recording hours worked

  • Submitting timesheets on time

The Company is not responsible for payment delays caused by missing, late or disputed timesheets.


10. Payment Arrangements

Payment is made via bank transfer only.

Rates of pay are agreed per assignment and may vary.

The Worker acknowledges that statutory deductions may apply, depending on engagement type.

The Company does not provide tax advice.


11. Absence and Availability

The Worker must notify the Company as soon as possible if unable to attend an assignment.

Repeated non-attendance, lateness or short-notice cancellations may result in withdrawal of future assignments.


12. Expenses

Expenses are only payable where expressly agreed in advance.

The Company reserves the right to decline expense claims that are unauthorised or unsupported.


13. Confidentiality

The Worker shall not disclose confidential information relating to the Company or any client.

This obligation continues after an assignment ends.


14. Data Protection

Personal data is processed in accordance with the Company’s Privacy Policy.

The Worker consents to the processing of personal data necessary for recruitment, placement, payroll and compliance purposes.


15. Equal Opportunities

The Company operates an equal opportunities policy.

The Worker is expected to treat others with dignity and respect and to comply with applicable conduct standards.


16. Termination of Engagement

The Company may terminate engagement without notice where required for legal, regulatory or operational reasons.

Termination does not affect accrued rights or payments due.


17. Limitation of Liability

To the fullest extent permitted by law, the Company shall not be liable for:

  • Loss of earnings

  • Loss of future work

  • Indirect or consequential loss

Nothing excludes liability that cannot be excluded by law.


18. Changes to These Terms

The Company may update these Terms from time to time.

The most current version will be published on the Company’s website.


19. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction.
